Virallyst provides an AI-powered content creation platform designed to help users generate social media content based on trends and user preferences. The Service includes content creation, scheduling, analytics, and optimization tools. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Accounts

To access certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Unless otherwise stated, subscriptions automatically renew for the same subscription term

  • All amounts paid are non-refundable except as required by law or as explicitly stated in these Terms
  • We may change our prices at any time, but will provide notice of any price change at least 30 days in advance

5. Intellectual Property Rights

Virallyst and its licensors retain all rights, title, and interest in and to the Service, including all intellectual property rights. The Service's text, graphics, user interface, visual interface, photographs, trademarks, logos, sounds, music, artwork, and computer code are owned or licensed by us and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the content you create using our Service, however you grant us a non-exclusive, worldwide, royalty-free license to use, copy, modify, adapt, and display this content for the purposes of:

  • Operating, improving, and promoting the Service
  • Developing and training our AI systems
  • Research and development purposes

6. User Content

You are solely responsible for the content you create, publish, or share through the Service. You represent and warrant that:

  • You own or have the necessary rights to the content
  • Your content does not violate these Terms or applicable laws
  • Your content does not infringe upon any third party's rights
  • Your content does not contain viruses, malware, spyware, or any other harmful code

7. Limitation of Liability

To the maximum extent permitted by law, Virallyst shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. In no event shall our liability exceed the amount you have paid to us in the 12 months preceding the event giving rise to the liability.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately, and we may delete or discard any content that you have submitted through the Service.

9. Changes to Terms

We may revise these Terms at any time by posting an updated version. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. 10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within Delaware.
